TERMS OF SERVICE (ToS) FOR NWTIA STUDIO

1. ACCEPTANCE OF TERMS

By accessing nowaythisisai.com ("Site") or purchasing the Genesis Vault ("Product"), you agree to these legally binding Terms. If you disagree, do not use the Site or purchase the Product.

2. INTELLECTUAL PROPERTY

All content on the Site and within the Genesis Vault (videos, PDFs, prompts, workflows, text, graphics) is the exclusive property of NWTIA Studio and protected under French/EU intellectual property laws. No content may be copied, modified, or used without prior written authorization.

3. LICENSE GRANT

Upon purchase of the Genesis Vault, you receive a non-exclusive, non-transferable, revocable license to:

• Use the prompts/workflows to generate original AI artwork.
• Sell or commercially exploit the final images you create.

Prohibited:

• Reselling, sharing, distributing, or reverse-engineering the Product's core content (e.g., videos, PDFs, prompts).
• Using NWTIA's trademarks/branding without permission.

4. LIMITATION OF LIABILITY (CRITICAL CLAUSE)

Tool-Only Provision: NWTIA Studio provides creative tools for generating AI art. We are not liable for your use of these tools.

Your Sole Responsibility: You are 100% legally responsible for:

• Ensuring generated images comply with copyright, privacy, and obscenity laws in your jurisdiction.
• Verifying that images do not infringe third-party rights (e.g., likeness, trademarks).
• Any legal claims arising from your published artwork.

Cap on Liability: In no event shall NWTIA's total liability exceed the Product's purchase price (€997).

5. PRIVATE COMMISSIONS POLICY

Application Process: Submit project details via our contact form.

Discretion: NWTIA Studio reserves the right to refuse any commission without explanation. Accepted projects require a separate contract.

6. REFUND POLICY

Digital products are non-refundable once downloaded.

7. GOVERNING LAW & DISPUTES

These Terms are governed by French law. Any disputes will be resolved exclusively in the courts of Paris, France.
